Attorney Biography:
Since joining the firm in 2005, Mr. Tomaszewski’s practice has been focused on complex environmental litigation involving major federal and state environmental statutes, including but not limited to CERCLA, RCRA, and the New Jersey Spill Act. In addition, Mr. Tomaszewski has substantial experience in complex insurance litigation related to claims for environmental property damage. Aside from litigation, Mr. Tomaszewski has advised both private and municipal parties on a range of environmental issues including administrative and regulatory matters.
Prior to joining the firm, Mr. Tomaszewski served as law clerk to the Honorable Harriet Derman, P.J.Cv., New Jersey Superior Court, Somerset County.
Representative Matters:
- Obtained summary judgment dismissal of claim brought under the New Jersey Spill Act against sole shareholder of gasoline service station for failure to plead circumstances justifying piercing the corporate veil.
- Represent a municipal authority in RCRA litigation filed in the United States District Court for the District of New Jersey against a former owner and operator of a chromium production facility to compel it to investigate and remediate contamination related to its historical operations.
- Provide strategic advice to municipal client in anticipation of litigation related to the Urban Rivers Restoration Initiative undertaken by the United States Environmental Protection Agency and United States Department of the Army.
- Represent small and mid-size businesses in a variety of matters, including employment disputes, contract drafting and dispute resolution, and business litigation.
