Attorney Biography:
David L. Isabel is a founding partner of the law firm of Golub & Isabel, P.C. Mr. Isabel represents his clients in a variety of complex environmental and insurance matters before trial and appellate courts. Mr. Isabel further counsels his clients on environmental compliance, due diligence, redevelopment and transactional issues. In 2006 and 2007, Mr. Isabel was selected as one of the New Jersey Rising Stars® and in 2010 as a New Jersey Super Lawyer® in the area of environmental litigation as published in New Jersey Monthly Magazine.
Representative Matters:
- Obtained a judgment in excess of $10 million against certain insurance companies that denied environmental insurance coverage to a private client for costs incurred defending, investigating, and remediating two Superfund sites after a three-week bench trial in New Jersey Superior Court.
- Obtained and enforced a judgment in excess of $8 million against an insurance carrier that had denied environmental insurance coverage to a private client after allocation proceedings before a Special Master.
- Negotiated nearly $5 million in pre-litigation settlements with certain insurance companies that issued policies between 1951 and 1985 to a private client for costs of defense, investigation, and remediation incurred at former manufactured gas plant sites and an oil and gas field.
- Represented a municipal authority in RCRA litigation filed in the United States District Court for the District of New Jersey against a former owner and operator of a chromium production facility to compel it to investigate and remediate contamination related to its historical operations.
- Negotiated and implemented an air monitoring and medical monitoring program for employees of a municipal authority located adjacent to a contaminated site where approximately 1 million tons of hazardous materials are being excavated pursuant to a long term remediation plan.
- Represent a private client before United States Environmental Protection Agency with respect to performance of obligations assumed under an Administrative Consent Order to investigate and remediate a former manufactured gas plant site in Florida.
- Provide advice and assistance to private client seeking to register a new pesticide with the United States Environmental Protection Agency pursuant to FIFRA.
- Represent city in litigation related to the Urban Rivers Restoration Initiative undertaken by the United States Environmental Protection Agency and United States Department of the Army on the Passaic River in New Jersey.
